Which Public Benefit Program Does a Beneficiary of a Special Needs Trust in New Jersey Qualify Under?

Determine the benefits the trust beneficiary receives from the Government

Is the special needs beneficiary a recipient of SSI and Medicaid?  How about SSDI and Medicare?  May be all four programs?  An explanation of the differences between the public benefit programs is very complex, but what you need to know are the resource and income limitations of the SSI and Medicaid programs as a trustee to the trust.  Start with the Social Security award letter.  Most benefits paid are done by direct deposit, so obtain a copy of the bank statement.  Sometimes you can figure out what the benefit is from the payment amount alone, but written confirmation is best.  The amount of the benefit and how distributions are made from the trust will be determined primarily by the beneficiary’s public benefits.
